1. Acceptance of Terms

By accessing or using SortedMindz ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not create an account or use the Service. These Terms constitute a legally binding agreement between you and SortedMindz.

2. Description of the Service

SortedMindz is a mental wellness platform that provides:

• Mood tracking and trend visualization
• Private journaling
• Guided breathing exercises
• Curated mental health resources
• Crisis support information

Important: SortedMindz is not a substitute for professional medical advice, diagnosis, or treatment. It is a self-help wellness tool. If you are experiencing a mental health emergency, please call 988 (Suicide & Crisis Lifeline) or go to your nearest emergency room.

3. Informed Consent for Data Collection

By using SortedMindz, you provide informed consent for us to:

• Collect your mood data, journal entries, breathing session records, and profile information as necessary to provide the Service.
• Store this data securely in encrypted databases with row-level security controls.
• Process this data to display your personal dashboard, trends, and statistics.
• De-identify and aggregate data for service improvement and research purposes, using the HIPAA Safe Harbor method to remove all 18 categories of personal identifiers.

4. De-Identification and Anonymization

You consent to the following de-identification practices:

• Your wellness data (mood entries, journal content, breathing sessions) may be de-identified and used in aggregate for product improvement, feature development, and anonymized research.
• De-identification is performed using the HIPAA Safe Harbor method, removing all personal identifiers before any data is aggregated or analyzed.
• De-identified data cannot be traced back to you and is no longer considered Protected Health Information under HIPAA.
• We maintain strict technical and organizational controls to prevent re-identification of de-identified data.

5. Consent for Data Sharing

You acknowledge and consent that:

• Your identifiable data will never be shared with third parties for marketing, advertising, or commercial purposes.
• De-identified, aggregated data may be shared with research partners under strict data use agreements.
• Your data may be disclosed when required by law, including but not limited to: subpoenas, court orders, and mandatory reporting obligations.
• Service providers who process data on our behalf operate under HIPAA-compliant Business Associate Agreements (BAAs).

6. Revoking Consent

You may revoke your consent at any time by:

• Navigating to Settings in your dashboard and updating your consent preferences.
• Contacting us at privacy@sortedmindz.com with a written request.
• Deleting your account, which removes all your data.

Revoking consent does not affect the lawfulness of data processing performed before the revocation. Revoking consent may limit or prevent your ability to use certain features of the Service. De-identified data that was aggregated prior to revocation cannot be retrieved or deleted as it is no longer linked to your identity.

7. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to: use a strong, unique password; not share your login credentials; notify us immediately if you suspect unauthorized access; and log out from shared or public devices.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Attempt to access another user's data or account.
• Interfere with the security or integrity of the Service.
• Use automated tools (bots, scrapers) to access the Service.
• Upload content that is harmful, abusive, or violates the rights of others.

9. Medical Disclaimers

SortedMindz is a wellness tool and does not provide medical advice, therapy, counseling, diagnosis, or treatment. The content, resources, and tools provided are for informational and self-improvement purposes only. Always seek the advice of a qualified healthcare provider for any medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or recorded in SortedMindz.

10. Limitation of Liability

To the maximum extent permitted by applicable law, SortedMindz and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time through your account settings. Upon termination, all your personal data and health information will be permanently deleted within 30 days. We reserve the right to suspend or terminate accounts that violate these Terms. Consent audit logs may be retained for up to 6 years after account deletion as required by HIPAA regulations.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which SortedMindz operates, without regard to conflict of law principles. HIPAA and related federal regulations take precedence where applicable.

13. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via email and/or in-app notification at least 30 days before they take effect. If changes affect your HIPAA consent, we will require your affirmative re-consent. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
